An Analysis of the Leasehold Concept in the Land Management System of Indonesia and Malaysia

Abstract: An analysis of leasehold concept in the investigation of the application of land management system and the features of the leasehold system in Indonesia and Malaysia which is predicated on independence of contract as a legal arrangement for land management and planning that encourages sustainable development. The approach is using analytical concepts of property rights under regulatory enactment applied in both countries and the innovation process. The researchers found the post-contractual imposition of statutory regulation of leasehold in land management system in Indonesia and Malaysia influence compliance to the leasehold system in achieving sustainability, the reinterpretation of statutory regulation in areas with a leasehold system and the reception of the land lease as a basis for innovations that help promote sustainable development. The researchers further develop the theory of planning by term of contract (lease) as an instrument of sustainable land management system in land development.
